Contour Built Pty Ltd
These Terms and Conditions apply to all quotations, products, custom fabrication work and sales supplied by Contour Built Pty Ltd.
By accepting a quote, placing an order, approving drawings or making payment, the customer agrees to the following Terms and Conditions.
1. Quotes
All quotations issued by Contour Built Pty Ltd are valid for 14 days from the date of issue.
Quotes are based on current material, labour and supplier pricing.
If a quote is accepted but the project is delayed by the customer, Contour Built reserves the right to re-quote the project if fabrication has not commenced within 6 months of quote acceptance due to fluctuations in aluminium pricing, labour costs or supplier costs.
2. Deposits
All custom fabrication orders require a $1000 + GST non-refundable deposit to secure the job.
Fabrication will not commence until the deposit has been received.
The deposit secures:
• production time
• materials
• scheduling within the fabrication queue
Deposits are non-refundable once fabrication or material procurement has commenced.
3. Final Payment
Full payment is required immediately upon completion of the product, unless otherwise agreed in writing.
Products will not be released, collected, installed or freighted until payment has been received in full.
Contour Built Pty Ltd reserves the right to charge interest on overdue invoices at 10% per annum, calculated daily.
The customer agrees to pay any legal, collection or administrative costs incurred in recovering unpaid debts.
4. Customer Measurements and Drawing Approval
Where products are manufactured using customer supplied measurements, the customer is solely responsible for ensuring all measurements are correct.
Where drawings are provided by Contour Built, the customer must carefully review and approve the drawings prior to fabrication.
Drawing approval confirms that the customer accepts:
• all dimensions
• layout
• materials
• design features
• door locations
• structural components
Contour Built Pty Ltd accepts no responsibility for errors in measurements or specifications supplied or approved by the customer.
Once drawings are approved and fabrication has commenced, any design changes or modifications requested by the customer will incur additional charges. Any changes throughout the design phase beyond the original design scope, also incur additional charges.
5. Vehicle Fitment and Tray Condition
Unless a vehicle has been physically measured by Contour Built Pty Ltd, fitment cannot be guaranteed.
Contour Built accepts no responsibility where installation issues arise due to:
• uneven trays
• twisted trays
• trays that are not square or level
• tray modifications
• vehicle modifications
• accessories interfering with installation
If a tray is found to be unsuitable for installation, any adjustments required to complete installation will be charged at additional labour rates.
Contour Built Pty Ltd is not responsible for rectifying tray or vehicle defects.
6. Installation
Unless specifically stated in writing, installation is not included in any quotation.
Customers are responsible for arranging installation of their products.
Contour Built Pty Ltd accepts no liability for:
• incorrect installation
• damage caused during installation
• vehicle damage resulting from incorrect installation
7. Freight and Delivery
Contour Built Pty Ltd can arrange freight Australia wide.
Once goods leave the Contour Built premises and are handed to a freight provider, all responsibility transfers to the freight carrier.
Contour Built Pty Ltd accepts no liability for freight damage, freight delays or loss of goods.
Customers may request freight insurance at additional cost prior to dispatch.
If freight insurance is not requested, shipments are transported entirely at the customer’s risk.
Customers must inspect goods immediately upon delivery and report freight damage directly to the freight provider.
8. Powder Coating Disclaimer
Powder coating is performed by independent third-party contractors.
Contour Built Pty Ltd does not provide any warranty or guarantee on powder coating finishes.
Powder coating may be affected by numerous environmental and usage factors including but not limited to:
• UV exposure
• off-road use
• chemical exposure
• pressure washing
• abrasion
• stone chips
• environmental contamination
• coastal environments
Fading, flaking, peeling, discoloration, corrosion or deterioration of the coating is considered normal environmental exposure and wear.
Contour Built Pty Ltd accepts no liability for powder coating performance or longevity.
Products should only be cleaned using water or mild automotive wash solution.
The use of degreasers, solvents, acidic cleaners, industrial cleaners, or abrasive products may damage the coating.
Any concerns relating to powder coating must be reported within 30 days of delivery or collection.
After this period, the powder coated finish is deemed to be accepted by the customer.
9. Moving Parts and Wear Items
Contour Built products contain components that are subject to normal wear and tear.
This includes but is not limited to:
• gas struts
• locks
• lock barrels
• hinges
• latches
• seals
• door mechanisms
• moving components
These parts are considered wear items and are not covered under warranty.
Contour Built Pty Ltd accepts no responsibility for failure, wear or replacement of these items over time.
10. Storage Fees
Customers will be notified when their product is complete.
Products must be collected within 7 days of completion.
If products are not collected within this timeframe, storage fees will apply.
Storage fees are charged at $150 per week until the product is collected.
Contour Built Pty Ltd accepts no responsibility for deterioration, damage or theft of items stored beyond the collection period.
11. Returns and Refunds
Due to the custom nature of many Contour Built products, returns are generally not accepted.
Returns may only be considered where a product has been manufactured incorrectly compared to the approved drawings or specifications.
Products that have been:
• installed
• used
• modified
• damaged after delivery
will not be eligible for return.
12. Product Use
Contour Built products are designed for agricultural, off-road and recreational applications.
Customers must ensure products are used safely and within appropriate load limits.
Contour Built Pty Ltd accepts no liability for damage caused by:
• misuse
• overloading
• improper mounting
• modification of the product
Products supplied by Contour Built are not safety devices and must not be relied upon for personal protection or animal restraint.
13. Intellectual Property and Design Protection
All product designs, fabrication methods, layouts and systems developed by Contour Built Pty Ltd remain the exclusive intellectual property of Contour Built.
This includes but is not limited to:
• Pig Hunter Dream Boxes
• Swing-In Swing-Out Door Systems
• Custom dog box configurations
• structural layouts
• proprietary fabrication techniques
These designs must not be copied, reproduced, reverse engineered or manufactured by any third party without written permission from Contour Built Pty Ltd.
Contour Built reserves the right to pursue legal action against any individual or business found to be copying or reproducing these designs.
14. Limitation of Liability
To the maximum extent permitted by law, Contour Built Pty Ltd will not be liable for:
• indirect losses
• loss of income
• loss of business
• loss of vehicle use
• consequential damages
Our liability is limited to repair or replacement of the product at our discretion.
15. Intellectual Property Recommendations
Contour Built Pty Ltd strongly protects its proprietary designs and branding.
The following protections apply:
Pig Hunter Dream Box™ is a proprietary product name belonging to Contour Built.
The Contour Built Swing-In Swing-Out Door System is a proprietary design concept developed by Contour Built Pty Ltd.
Contour Built actively monitors the market for copying or imitation of its designs and reserves the right to enforce its intellectual property rights.
